
It is common to find the concept of Created Land (Solo Criado) in Master Plans (PD) and Land Subdivision, Use, and Occupation Laws (LPUOS). This concept enables the implementation of certain urban planning instruments, such as the Onerous Grant of the Right to Build (OODC) and the Transfer of Development Rights (TDR). But what exactly is Created Land?
First and foremost, it is important to understand that owning land does not grant unlimited development rights over it, as urban planning regulations themselves impose restrictions. One example is the floor area ratio (FAR), also known as the utilization index, which is the ratio between the buildable area and the total lot area. This coefficient is the value that, when multiplied by the lot area, defines the maximum allowable construction area. For instance, when a lot has a floor area ratio of 1, the total built area can only equal the area of the lot itself.
